METALÚRGICA SIEMSEN LTDA, enrolled with the CNPJ under No. 82.983.032/0001-19, headquartered at Rodovia Ivo Silveira No. 9525, CEP 88.355-202, Bairro Volta Grande, in the city of Brusque, in the State of Santa Catarina, hereinafter referred to as SKYMSEN, owner of the websites: www.skymsen.com, www.skymsen.com.br, loja.skymsen.com, www.campanhakymsen.com.br, www.skymsenpromo.com, usead.skymsen.com, usead.skymsen.com.br, usead.siemsen.com.br presents its Privacy Policy.
The protection of personal data is an issue taken very seriously by SKYMSEN. In this sense, SKYMSEN will always treat Personal Data confidentially and in accordance with current legislation, in particular Laws No. 13.709/18 (Personal Data Protection Law or LGPD), 8.078/90 (Consumer Protection Code or CDC) and 12.965/2014 (Civil Rights Framework for the Internet or MCI).
This Privacy Policy is intended to provide information to Holders about how SKYMSEN will process their Personal Data.
Therefore, reading and understanding this document is of great importance. In case of any doubt, SKYMSEN can be contacted through the channels informed at the end of the document.
Important Definitions
This Policy uses technical concepts provided for in the applicable legislation, in particular those provided for in art. 5 of the LGPD. For ease of reading, below are indicated the main concepts used:
Controller: individual or legal entity, governed by public or private law, who is responsible for decisions regarding the processing of Personal Data;
Personal Data: any information related to an identified or identifiable natural person, that is, information that directly identifies a person, such as full name, CPF, RG, photograph or that indirectly identifies them, email address, IP, location, for example;
Sensitive Personal Data: information that reveals more intimate characteristics of the Holder, which may even generate some discriminatory treatment, such as racial or ethnic origin, religious conviction, political opinion, union membership or organization of a religious, philosophical or political nature, data related to health or sexual orientation, genetic or biometric data, when linked to an individual person;
Domain: a set of characters that serves to locate and identify a person or company on the Internet.
Internet Protocol (IP): It is a set of numbers that identifies the Holder's computer on the Internet;
Operator: individual or legal person, under public or private law, who processes Personal Data on behalf of the controller;
Holder: individual person to whom the personal data processed refers;
Processing: any and all operations carried out with Personal Data, whether by the Controller or the Operator, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction.
What Data Do We process and For What Purposes?
As a rule, SKYMSEN will exercise the condition of Controller of the Personal Data under its responsibility, and may in some cases share it with other Controllers or Operators, as set out below.
The Personal Data Processed by SKYMSEN can be classified as to origin as:

Data provided by the Holder: Data provided by express and conscious action of the Holder, such as when he registers in our online store on the website loja.skymsen.com;

If you are interested in participating in the selection processes at SKYMSEN through third party portals, such as recruitment and selection companies, etc. it is important that you read and understand the Privacy Policies of these third parties. We have no responsibility for the data requested or the processing carried out by such third parties.
If you have applied for a job at SKYMSEN and are not selected, your data will be stored securely and deleted after a period of 12 (twelve) months, counted from the end of the selection process.

Data Sharing with Third Parties
SKYMSEN may also share with third parties, always under its supervision, the Personal Data listed above in the following cases:

Anti-fraud and credit analyses: We may share data such as CPF, email, telephone, etc., with banks and specialized companies, for credit analysis, confirmation of the identity of the Holder and verification of the veracity of the data provided, in order to prevent fraud;

Logistics and Delivery: During the logistics management procedure of the delivery of goods, we can share data such as Name, Identification document (RG, CPF or CNH (driver’s license)), address, E-mail and Telephone, with dispatchers,SKYMSEN's partner freight forwarders and transport companies;

Advertising and marketing: With marketing agencies, for the development of campaigns and forwarding of materials to the Holders, as well as with market intelligence tools;

Support for SKYMSEN processes: Enable the fulfillment of the contracts signed between Clients and SKYMSEN, through companies specialized in auditing, technical assistance, accounting, advocacy, etc.;

With public agencies or private agencies: In the performance of a typically public activity to comply with a determination or legal obligation, with treasury agencies, in complying with judicial requests, for example;
International Transfer of Personal Data
SKYMSEN may carry out international data transfers in order to carry out some processes that make up the operation, such as storing information on international servers, etc.
In any case of sharing with partners located in other countries, we contractually establish that the partner has a duty to maintain the standard of data protection and information security compatible with this Privacy Policy and the LGPD.
Rights of Personal Data Subjects

IMPORTANT! We respond to requests within the legal deadline. However, if there is a legal basis, some requests may be partially met or even denied, situations in which we will provide the necessary clarifications and justifications.
Data Maintenance
The personal data described above will be kept by SKYMSEN or authorized third parties for as long as necessary to fulfill their purposes. In addition, the data may be kept (i) in the event of a legitimate interest, as legally defined; and (ii) when law or public authority so determines.
The maintenance of the data after the termination of the contractual relationship will be carried out only for a period sufficient to guarantee the achievement of the purposes indicated in this Policy, as well as for situations of compliance with a legal obligation.

With some precautions, the Holder may contribute to a safer relationship in relation to the processing of their Personal Data. Below are some tips:

Do not provide information such as bank or financial passwords by email or other messaging applications (e.g. whatsapp, telegram, etc.);

Notify SKYMSEN of any suspicion or finding of violation of this Policy, such as the misuse of your Personal Data by third parties;

Consult SKYMSEN whenever you receive information or communications about promotions, campaigns and surveys received by email, to verify their veracity;

Provide SKYMSEN with truthful and complete information and always keep it up to date;

Adopt cybersecurity measures on the devices used in the interaction with the website, such as the use of strong passwords and periodic change; update of antivirus, firewalls and others;
